The NFL goes to the U.S. Supreme Court in Anti-trust Lawsuit?

No matter how much you love football always keep in mind it is BIG buisness!

In the legal equivalent of running up the score, the NFL is going to the U.S. Supreme Court in search of a bigger victory in an antitrust tussle over team merchandise than it already won from a lower court.

The Supreme Court could decide as early as Monday whether it will hear the case, which involves American Needle Inc.'s challenge to the league's exclusive contract for selling headwear such as caps and hats with team logos on them.

American Needle of Buffalo Grove, Ill., also is urging a high court review. Football team owners hope the Supreme Court will issue a broader decision that would insulate the NFL against what they contend are costly, frivolous antitrust lawsuits.

At the heart of the matter is whether the NFL's teams constitute 32 distinct businesses or a single entity that can act collectively without violating antitrust law.

The case is important to other professional sports besides football. The NBA and the NHL both have filed friend-of-the-court briefs siding with the NFL.

Notably absent is Major League Baseball, which has an antitrust exemption thanks to a 1922 Supreme Court ruling.

"Member clubs of the NFL have no independent value, no purpose, indeed no meaningful reason for existence but for their participation in the league itself," the NFL argues. It cited a ruling in an antitrust challenge involving the NBA, in which an appeals court wrote: "A league with one team would be like one hand clapping."

The NFL argued that professional sports leagues should be deemed single entities for purposes of antitrust law, at least concerning core venture functions.

American Needle had been one of many companies that manufactured NFL headwear. In 2001, the league granted an exclusive contract to Reebok. American Needle sued the league and Reebok in 2004, claiming the deal violated antitrust law.

A federal district court disagreed, saying that the teams acted as a single entity in licensing their intellectual property. Last year, the 7th U.S. Circuit Court of Appeals in Chicago affirmed that ruling.

"Asserting that a single football team could produce a football game is less of a legal argument," the court said, than "a Zen riddle: Who wins when a football team plays itself?"

The appeals court said that the league isn't always a single entity, but that nothing in antitrust law prohibits the teams from cooperating so the league can compete against other forms of entertainment.

If the Supreme Court declines to take the case, the appeals court ruling would be left in place.

American Needle argued in its legal filing that the appeals court decision contradicted a 1957 Supreme Court ruling that refused to extend baseball's antitrust exemption to professional football.

The solicitor general's office, after being asked by the Supreme Court to weigh in on the current case, urged the court not to take it. The government said the lower court ruling does not conflict with any decisions by the Supreme Court or other appeals courts -- contrary to arguments made by American Needle and the NFL.

Gary Roberts, dean of the Indiana University School of Law-Indianapolis and an expert on sports law, said that the NFL senses it has a favorable Supreme Court makeup.

"They would like to have the Supreme Court resolve this single entity issue now," said Roberts, a former lawyer for the NFL. "Even though they risk losing this case, the potential gain for all sports leagues from having the Supreme Court affirm the decision would be huge."

Episode 6 started with the expectation that one of the defensive backs would be going home.  There were 4 DBs but only 3 WRs after Speedy Gonzales dropped the ball in the last episode.

 

 

The show started with a kick/punt return drill and the DBs looked terrible.  Their yards per return were half that of the DBs.  So it looked like one of them was going home.  Then Irvin instructed the players have a flag football game in which the losers had to cook for the winners which was a bit lame but it let you get to know the players a little bit.

 

Then for a treat / lesson in being an adult Irvin sent the players to former Cowboys' special teams coach Joe Avezzano’s Bar called “Hat Trick” for a night out.  This was a test to see who would get out of control or maybe drink too much.  The guys passed but got in at 3am.

 

At 6am it was Navy Seal drill them to they quit time.

 

All seven players were put through a series of physical drills to see who would quite first.  Quite and you went home.  After 4 hours it looked like several of the players might call it quits. At the 5 hour mark Irvin must have realized that someone was going to get hurt or worse and he stopped the drill.

 

No one was cut after putting in such an effort.  It was a nice way to end the show.  This week watch two guys get cut.

Dallas Cowboy Lineman "Free Reign" sign music deal!!! What about football???

Dallas Cowboy lineman Leonard Davis, Marc Colombo and Cory Procter have signed a recording contract as part of a heavy metal band called "Free Reign."

Their debut album for Australia's Riot Entertainment will be released this fall (isn't that football season???).

Considering all three players weigh over 300 pounds, it only makes sense they are being referred to as "heavier than metal."

Guitarist Justin Chapman is the fourth member of the group. Their final gig of the offseason is Saturday at the House of Blues in Dallas.

I believe that everyone needs something outside of their day job to keep their sanity.  Tony Romo for example plays in golf tournaments and drives his new boat.  Some pro athletes do commercials and other endorsment deals but right now I want guys who play football and win Super Bowls.  Emmitt Smith didn't Dance with the Stars until after he won three Super Bowls.  Win the Super Bowl and the offers will follow.

La’Roi Glover, a six-time Pro Bowl and former Cowboy retires!

La’Roi Glover, a six-time Pro Bowl selection at defensive tackle who played with the Dallas Cowboys from 2002-2005, announced his retirement Monday after 13 seasons.

Glover, who turns 35 on July 4, spent the past three seasons with St. Louis. He was not re-signed following the 2008 season, when he had 30 tackles and one-half sack. A Rams spokesman said the team had no comment.

“I’m blessed that I was able to play this game that I love for so long. It has been such an incredible journey,” Glover said in a prepared statement.

Glover was selected by Oakland in the fifth round of the 1996 draft out of San Diego State. Considered undersized at 290 pounds, he played in just two games as a rookie, with two tackles and no sacks.

His career took off a year later in New Orleans, where he had 50 sacks over five seasons, including an NFL-best 17 in 2000 — a rare feat for a tackle. From 1998 through 2000, only two players had more sacks than Glover’s 35.5 — Kevin Carter (39.5) and Warren Sapp (36). Glover had 21.5 sacks in four seasons in Dallas, and 12 in three seasons in St. Louis. He signed with the Rams as a free agent before the 2006 season.

Dallas Cowboys June 2009: Mini-Camp video Highlights!

It's clear the guys are working hard at this week's mini-camp.  This quick snapshot shows a hand full of nice plays and note the run by Felix Jones at the end.  He is running at full speed and looks good.

The bad news is there were several interceptions thrown.  It is not clear who through all of them but it is concerning coming off of last year.

I did some digging around and was able to find some background information on some of the remaining players.  This week I say look for the guy who is flying under the radar.  Look for the guy who has not been in to see Irvin and company.  Anyway here is some background info that I could find.

Jean-Jacques Taylor Columnist for the Dallas Morning News is an Idiot on Video!

Mr. Taylor went on the NFL Network and predicted the Cowboys to would finish the 2009 season at 8 – 8.

I know he does not want to be seen as a ‘homer’ but 8-8 is just nuts.  The Cowboys offense has three legitimate number 1 running backs that will be able to wear down any defense.  Romo should be wiser then last season and should be able to cut down the turnovers which killed the team.  They still have the best TE in football and they have enough receivers to move the ball down the field.  Even if Williams has an average year with the three headed monster at running back he won’t have to carry the load.

 

The defense should be as good if not better then last season.  They will be younger and faster and with SS Sensabaugh learning the system they will have improved that position as well.

 

The Cowboys will most likely split the divisional games which is 3 wins there.  They have a tough schedule but there are three games that should be no contest.  So for Mr. Taylor to be right they would go 2 and 5 the rest of the season.  I think he overestimates the rest of the league and under estimates the Cowboys!

It has been talked about for three seasons now.  “Romo folds like a cheap suit come December and playoff time.” Well not so fast…a lot of teams don’t do well in December and January that is why there is only one Super Bowl winner each year.  NY Giants QB Eli Manning got the same rap before he won the Super Bowl two seasons ago.  Cowboy’s fans will remember that Eli had not won a playoff game until the week before they beat the Cowboys on their way to the Super Bowl.

 

 

Assistant Head Coach Jason Garrett has told Romo he needs to get in better shape so that he is better off at the end of the season.  Personally, I think Garrett needs to do a better job getting Romo prepared in August so that he doesn’t turn the ball over so much.  Even if some of it is fatigue; most of it is just protecting the ball better which is coaching not conditioning.

 

I do have my concerns that the almost married life to singer-actress-personality Jessica Simpson may be taking the edge off.  Romo is out on the new boat she bough him and playing golf while he should be in the weight room.  Lord knows she lost her shape this off-season.

Roger Staubach & Speedy Gonzales Star in Episode 5 of Irvins's 4th and Long!

Roger Staubach made a short but pointed cameo appearance where he got to plug his charity www.TXTough.org .  I had hope he would give a little more insight to the players but it was right back to football.

 

Philadelphia Soul WR Steve “Speedy” Gonzales made a bold move to ‘take it to the field’ in a best 3 of 5 plays.  ‘Speedy’ came up just a step slow!  I think he will get picked up by someone.  Even if it is for a practice squad.  He has good skills.  He should have remembered that even the best QBs in the league only have a 55 to 65 completion %.

In what was a good episode that included former Cowboy Darren Woodsen the ice packs were out in force.  Irvin pushed the guys to their limit by running the two minute drill over and over.  The observation I made was that the speed of the play was much better then previous shows.  There were several nice plays on both sides of the ball.  But someone had to be cut.

It was little surprise the WR Luke Swan was cut.  With such little time to show his skills riding the bike was not going to help his cause.  There is just no time.  He had done well up until he got hurt but not that much better then the others.
